Acceptance
By using this website, you agree
By visiting this website, you acknowledge that you have read these Terms, understand them, and accept and agree to be bound by them.
You must be at least 18 years old to use this website or to request services from us through it.
If you are using this website on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms (in which case “you” and “your” refer to that organisation).
If you do not agree with these Terms, or are under 18, do not use this website. If at any time you are not willing to be bound by them, stop using the site and delete any copies of materials you have downloaded.
What this site is
Information, not an engagement
Content on this website is general information about AP Advisory, the Private Strategic Office™, Founder Counsel, and related methods. It does not create an advisory, coaching, fiduciary, or professional engagement. A private engagement begins only under a separate written agreement between you and us.
Through this website you may, among other things: read public pages; request a confidential briefing; subscribe to The Founder's Brief; or contact us by email or telephone. Those pathways are part of the “Service” for the purposes of these Terms.
Website content does not replace legal, tax, accounting, financial, investment, or other licensed advice. Decisions that affect ownership, capital, succession, or enterprise value should be taken with the appropriate licensed specialists for your situation.
Accounts and forms
No public member accounts
This website does not offer a public login or member account. Where you submit a form (for example a briefing request or a The Founder's Brief subscription), the information you provide must be accurate and current.
You must not provide false information, impersonate another person or organisation, or use another person’s details without authorisation. We may decline, suspend, or stop responding to requests that breach these Terms.
Rights under these Terms are personal to you. You may not assign, sublicense, transfer, sell, lease, or otherwise dispose of access to the Service or our materials, except as we expressly allow in writing.
Fees
Website use and paid work
Browsing this website is free. Requesting a briefing or subscribing to The Founder's Brief does not, by itself, create a paid engagement.
Any paid advisory work is governed by a separate written agreement (including scope, fees, and any refund or termination terms). Unless that agreement says otherwise in writing, fees paid for agreed services are non-refundable once work has commenced as described in that agreement.
Outcomes
No guaranteed results
We provide strategic counsel and related advisory services where engaged in writing. We do not guarantee any specific commercial, financial, personal, or enterprise outcome. Results depend on many factors outside our control, including your circumstances, decisions, timing, counterparties, and specialist advice from others.
Examples, case language, or illustrations on this website (if any) are not promises that you will achieve the same result. You remain responsible for your own decisions and for obtaining advice appropriate to your position.
To the fullest extent permitted by law, the website, its content, and downloadable materials are provided on an “as is” basis without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Use of the website is at your own risk.
In no event will we be liable to you for any indirect, incidental, special, or consequential loss, or for loss of profit, opportunity, or data, arising from use of this website or reliance on its content, whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law or other applicable law.
Information you send
Consent to use information
By submitting a form or communicating with us, you agree that we may collect, use, and disclose the information you provide for the purposes described in our Privacy Policy, including responding to you, administering a briefing request or subscription, and (where you consent) sending The Founder's Brief or related updates.
When you send us messages or materials, you grant us a non-exclusive, worldwide, royalty-free licence to use that content as needed to operate the website, respond to you, and deliver the services you requested. We do not claim ownership of confidential commercial information you share under a separate engagement; that is handled under that engagement’s terms.
Intellectual property
Our content remains ours
The website, text, design, drawings, marks (including Private Strategic Office™ where used), and other materials (“Content”) are protected by Australian and international intellectual property laws and are owned or controlled by B Positive Group Pty Ltd / AP Advisory, or by the credited provider.
Except for a limited, revocable licence to view the website for your own informational use, these Terms grant you no ownership or other right in the Content or our marks. You must not modify, publish, sell, reproduce (beyond ordinary browser caching or personal reference copies), create derivative works from, distribute, or exploit the Content or Service in whole or in part without our prior written consent.
Termination
Ending access
We may modify, suspend, or discontinue all or part of the website or related public services at our discretion, including where you breach these Terms. You may stop using the website at any time. To end a The Founder's Brief subscription or ask us to stop contacting you, email info@ashplaystedadvisory.com.
General
Changes, law, and contact
These Terms may only be changed in writing as posted on this website (or by a duly executed agreement). We may update features or pages; new features remain subject to these Terms.
